Steroid Charges

New Jersey law classifies anabolic steroids as a Schedule III controlled dangerous substance (CDS). In fact, lawmakers are so concerned with steroid use that they have adopted N.J.S.A. 24:21-7(a) to specifically address possession and distribution (i.e. possession with intent) of this form of CDS.  The law is intended to deter those who possess or distribute steroids by creating significant fines, jail time and other penalties for those who violate the law.  If you have been charged with a steroid offense, we can assist you. Possession of Steroids

While many believe that steriod use is not addictive, this is not reality in terms of the law. All forms of steriods are prohibited absent a valid prescription. The law actually sets forth a number of anabolic substances that fall within this prohibition and they include:

  • Dehydrochlormethyltestosterone
  • Dihydrotestosterone (4–dihydrotesterone)
  • Drostanolone
  • Ethylestrenol
  • Fluoxymesterone
  • Formebulone (formebolone)
  • Mesterolone
  • Methandranone
  • Methandriol
  • Methandrostenolone
  • Methenolone
  • Methyltestosterone
  • Mibolerone
  • Nandrolone
  • Norethandrolone
  • Oxandrolone
  • Oxymesterone
  • Oxymetholone
  • Stanolone
  • Stanozolol
  • Testolactone
  • Testosterone
  • Trenbolone
  • Any salt, ester, or isomer of a drug or substance described or listed above, if that salt, ester, or isomer promotes muscle growth.

If you are convicted of possessing any quantity of steroids under N.J.S.A. 2C:35-10 at the county courthouse in Freehold, you will have a felony criminal record. The grade of offense is what is termed a third degree crime. A third degree crime of this nature exposes an individual to a fine of up to $35,000, a Drug Enforcement and Demand Reduction Penalty (“DEDR”) of $1,000, and up to five (5) years in state prison. A drivers license suspension of at least six (6) months also applies absent a showing of extreme hardship. Distribution of Steroids

If you were arrested for selling, distributing or possessing steroids with intent to distribute, you face serious penalties under N.J.S.A. 2C:35-5.  Depending on the dosage units allegedly sold, you could face a prison term of 3-5 years for third degree distribution, 5-10 years for second degree distribution and 10-20 years for first degree distribution. The fines are likewise stiff with potential responsibility of $25,000 for a third degree crime, $150,000 for a second degree crime and $200,000 for a first degree crime. The DEDR penalties are $1,000, $2,000 and $3,000, respectively.  The penalties just described are even worse where the steroid distribution charge involves distribution in a school zone or intent to distribute in a public park.
