Wall New Jersey Drug Possession Charge

The largest number of possession charges arise out of N.J.S.A. 2C:35-10. A cds possession offense can fall under one of three grades under this statute. Possession of 50 grams or less of marijuana is a disorderly persons offense. Possession of in excess of 50 grams is a fourth degree crime. Possession of four or less dosage units of a prescription legend drug such as Oxycontin (a.k.a. Oxycodone, Hydrocodone, etc.), Xanax and Suboxone is also a fourth degree crime. Almost every other variety of cds possession is a third degree crime including cases involving heroin, cocaine, methamphetamine, GHB and 5-99 dosage units of a prescription drug.

Penalties for Drug Possession. A third degree crime for possessing cds/drugs like cocaine and heroin results in a fine of up to $35,000 and up to 5 years in prison under 2C:35-10(1). Fourth degree possession of marijuana and prescription drugs results in a period of incarceration of up to 18 months. The maximum fine is $200,000 for fourth degree prescription drug possession and $25,000 for possessing more than 50 grams of marijuana. A disorderly persons offense for possession of marijuana carries a fine of up to $1,000 and up to 6 months in the county jail. All cds possession convictions, as well as drug paraphernalia charges, also trigger a mandatory driver’s license suspension of 6-24 months.
