Middletown DWI Attorneys

Driving While Intoxicated Lawyer in Middletown NJ

If you are looking for a power house of experienced DWI lawyers for a case in Middletown, you have found what you are looking for. We are clearly the largest drunk driving defense firm in the state and also happen to be based just down the road from the Middletown Municipal Court on Highway 35. All six (6) of the attorneys on our team are Alcotest certified, meaning that they are among the approximately fifty (50) lawyers in the state who are as qualified as the police in operating and maintaining the breath test machine. As if that were not enough to convince you that we take defending driving while intoxicated cases very seriously, five (5) of the attorneys are also certified in Standardized Field Sobriety Testing, a qualification that most police officers do not even hold, and only approximately ten (10) lawyers in the state possess. In other words, the Middletown DUI defense lawyers at our firm are among a handful of individuals qualified on both the Alcotest and Field Sobriety Tests (i.e. the primary ways police prove intoxication). When you consider that we are also former prosecutors in over twenty five (25) municipalities in the area, including the adjacent towns of Holmdel and Hazlet, you understand why we have the confidence to describe our firm, the Law Offices of Marshall, Bonus, Proetta & Oliver, as such an exceptional choice to handle your DWI in Middletown.

Why Hire Us? We represent individuals who are interested in results because, while we are not the most expensive firm, we also are not going to be the cheapest. It would be impossible for us to possess such a qualified staff and produce the results that we do  (i.e. probably over 50% probability of downgrading or dismissing your DWI).  In order to properly defend driving while intoxicated charges, we typically have to turn a case into a marathon, exploring every issue in hopes of avoiding the bar against plea bargaining. This is what must be done in order to come up with a bona fide proof issue to allow the prosecutor and judge to downgrade or dismiss a DUI offense. When you hire our firm, you have the commitment of an extraordinarily experienced and qualified defense team, that the state’s case will be challenged so that you get the best possible result rather than a quick plea. This approach certainly is not the norm in dwi cases in our experience.

Penalties You Want to Avoid. Lets face it, your objective is to avoid fines, license suspension, jail and other penalties when you hire an attorney. It is therefore important to know what the standard penalites would be if you handled the case on your own or hired a lawyer who is going to essentially plead you out. For a First Offense, the fines and mandatory assessments range from approximately $800 to $1,000. The suspension period is three (3) months to one (1) year depending on your blood alcohol content (BAC) but it is important to keep in mind that it is illegal to simply downgrade a dwi (e.g. reduce a second tier dwi of .10% or more to a first tier of .08 to .99) such that it is necessary for an attorney to get the breath test readings dismissed to obtain a reduction of the charge. For s second offense, the fines and assessments will approximate $1,200, the mandatory license suspension is two (2) years, and the jail time ranges from two (2) days to ninety (90) days. A third offense carries monetary penalties of approximately $1,500, a ten (10) year loss of license and 180 days of jail. The Division of Motor Vehicles also levies a surcharge of between $1,000 and $1,500 per year for three (3) years when someone is found guilty of driving while intoxicated.
