DUI Offense in Long Branch New Jersey
A conviction for a DUI offense carries significant penalties. This is the primary reason why it is so important to select a lawyer with the qualifications to avoid a finding of guilt. You will be subject to the following consequences if you fail to successful attach the charge.
- First Offense. A first offense results in a fine of $250–$400 if your BAC is between .08% but less than .10% (i.e. First Tier) and $300–500 if the BAC reading is .10% or more (i.e. Second Tier). The related period of driver’s license suspension is 3 months for a first tier and 7-12 months for a second tier. Court assessments are extensive at approximately $400 with a DMV surcharge also becoming due in the amount of $1,000 per year for three years. The second tier penalties apply to a first offense involving driving under the influence of drugs.
- Second Offense. A second DWI offense triggers a $500–$1,000 fine and substantially similar assessments to a first offense. A mandatory license revocation of two years results from a second conviction. You can also be sentenced to 2-90 days in the Monmouth County Jail. The same $1,000 annual DMV surcharge applies for three years.
- Third Offense. A third offense carries a $1,000 fine and substantially similar court assessments as a first and second offense. The license suspension is ten years. There is also a 180 day jail term.
It is important to keep in mind that the aforesaid penalties cannot be avoided through plea bargaining. This practice is outlawed in DWI cases. Your attorney will have to successfully defend the violation on its merits in order to avert a conviction.
