Elements of Boating DWI
There are three ways for an individual to be convicted of operating a boat while intoxicated under N.J.S.A. 12:7-46.
- Being Under the Influence of alcohol or drugs;
- Possessing a blood alcohol concentration (BAC) of .08% or more; or
- Allowing another to operate your boat while they are under the influence of alcohol, drugs, or with a BAC of .08% or greater.
Penalties for Violating N.J.S.A. 12:7-46
For a first offense, a fine of between $250 and $400 must be imposed along with a mandatory boat license suspension of 12 months and driver’s license suspension for three (3) months. The fine ranges from $500 to $1,000 for a second offense, with a boat license suspension of two (2) years, motor vehicle license suspension of six (6) months, and mandatory jail of 2 to 90 days. Conviction for a third or subsequent offense carries a fine of $1,000, mandatory jail of 180 days, and a boating license suspension of ten (10) years and drivers license suspension of two (2) years.
