Penalties. The primary mission of the juvenile court is to rehabilitate rather than punish so, not surprisingly, the penalties tend to be less severe. The maximum period of imprisonment/detention is 4 years for a first degree crime (e.g. armed robbery, distribution of 100 milligrams or more of LSD, etc.), 3 years for a second degree crime (e.g. aggravated assault, sexual assault, etc.), 2 years for a third degree crime (e.g. possession of ecstasy, possession of mushrooms, terroristic threat, etc.), 1 year for a fourth degree crime (e.g. distribution of less than one ounce of marijuana, shoplifting merchandise with a value of at least $200 but less than $500, etc. ) and 6 months for a disorderly persons offense (e.g. simple assault, disorderly conduct, etc.).

Necessity for an Attorney. Whenever a child appears in the Superior Court in response to a criminal offense, they must be represented by an attorney. This is a strict requirement of NJ Law and there is no ability for a parent to appear on behalf of their son or daughter. You must regain a lawyer to defend your child absent your qualifying for a public defender because you are considered indigent.
