Monmouth County NJ DWI Attorney

There is no debating the fact that New Jersey takes a hardened approach to DWI. It is one of very few states where there is no provision for a work license and where suspension of driving privileges is mandatory for even a first offense of DUI. The state has also prohibited plea bargaining in driving while intoxicated and under the influence cases. This means that the judge hearing your case cannot even consider downgrading your charge unless there is some issue that renders the prosecutor’s case flawed. To make matters even worse, the fines, surcharges and other penalties are severe if you are convicted. The court must even send you to jail for a second or third offense.  It is therefore crucial for anyone charged with DWI or DUI to do their  homework and hire the most qualified attorney they can find.

Experience & Training That Is Top Notch

When it comes to proving a N.J.S.A. 39:4-50 violation in New Jersey, the state can utilize scientific evidence or Standardized Field Sobriety Testing (“SFST”) to prove a case. As to the first method, prosecutors typically use a breath test reading of .08% or higher to establish intoxication. Where this approach fails because of a malfunction or other reason, the police can still rely on SFST results to prove a DWI offense.  Your attorney will have to invalidate both forms of proof in order to avoid a DUI conviction as plea bargaining is illegal. An attorney who is highly skilled in both approaches is clearly what you need if you are going to escape this offense.

The attorneys at our firm, including Jonathan Marshall and Colin Bonus, have exceptional training in both breathing and SFST. Four (4) of our lawyers are among the 50 or so statewide who are certified as operators of the Draeger Alcotest 7110, the machine used by every police department in Monmouth County. This training is far more in depth than the typical officer and this allows us to not only pinpoint defects in breath test readings but also equip us with superior knowledge when it comes to court. In addition, there are only approximately 5 attorneys in the state that are certified as instructors in SFST by the National Highway Traffic Safety Administration. Two of the attorneys at our firm possess this certification, allowing them to identify shortcomings in instructions, administration of tests, and scoring of performance. Errors like these can result in suppress of the blood alcohol results. We are obviously well schooled in DWI/DUI defense and know how to get results.
