When it comes to proving a N.J.S.A. 39:4-50 violation in New Jersey, the state can utilize scientific evidence or Standardized Field Sobriety Testing (“SFST”) to prove a case. As to the first method, prosecutors typically use a breath test reading of .08% or higher to establish intoxication. Where this approach fails because of a malfunction or other reason, the police can still rely on SFST results to prove a DWI offense.
