In response to some highly publicized incidents of parents fighting at youth sporting events, the legislature adopted a specific aggravated assault provision on this issue. The related offense is contained at N.J.S.A. 2C:12-1(f) and elevates a simple assault to a fourth degree aggravated assault if the incident occurs at a school or community sponsored youth sports event while child under sixteen (16) are present. The term “youth sports event” is defined as competition, practice or instructional event involving a team(s) organized pursuant to a nonprofit or similar charter or which are member teams in a youth league organized by or affiliated with a county or municipal recreation department. The statute specifically excludes incidents that occur at collegiate, semi-professional or professional sporting events. An aggravated assault offense in the fourth degree can result in 18 months in prison and a maximum fine of $10,000.
